Stuart V. Kennedy, LL.B(Hons), FRICS, FCIArb, C.Arb, Barrister-at-law

Barrister

Stuart Kennedy practises as a Barrister, Arbitrator and Mediator in national and international disputes from Chambers in London and in the Caribbean. He also sits as a Deputy District Judge in England. He is a Chartered Arbitrator, Chartered Surveyor and Barrister in England and in St Vincent and the Grenadines.

Stuart is an experienced arbitrator, adjudicator and mediator in commercial disputes in the Caribbean, the UK and internationally. Stuart has a wide experience in land, property, construction and engineering disputes having dealt with matters in the UK, the Caribbean, the Middle East and the Far East. He has acted as a conciliator and has undertaken a number of Early Neutral Evaluations and Expert Determinations. Stuart is a qualified trainer with the Chartered Institute of Arbitrators and has run and delivered numerous training courses in London, Dubai, Kenya, Barbados and Guyana. He regularly lectures on all forms of Alternative Dispute Resolution.

Dr. Kariuki Muigua

Law Scholar, Mediator, Chartered Arbitrator

Dr. Kariuki Muigua is a law scholar, Mediator, Chartered Arbitrator and holds Ph.D in law, LLB and LLM from the University of Nairobi. He has training and experience in International and Domestic Commercial Arbitration and Mediation, Policy Formulation and the Legislative Process. He is the (CIArb) Regional Trustee for Africa.

He was the Chairman (CIArb)-Kenya from 2012-2015. An Advocate of the High Court of Kenya of over 31 years standing. He practises at Kariuki Muigua Co. Advocates.

He is recognised nationally and globally and rated by Chambers and Partners as one of the best dispute resolvers in the country. He has a sterling background in Commercial, Constitutional, Environment and Natural Resource matters. He is a Senior Lecturer of law at the University of Nairobi and has published in the areas of ADR and Access to Justice, Environment and Natural Resources.

Gladys Wamaitha

Arbitraor/Mediator

Gladys Wamaitha has over Twenty (20) years’ experience and is an expert in Commercial, Civil litigation and Dispute Resolution. She believes everyone is entitled to an even playing field and every dispute can be resolved if it is managed efficiently, professionally and is cost effective. She is a holder of a Bachelor of Arts (B.A) and Bachelor of Laws (LLB) degree, Post graduate Diploma in Law from the Kenya School of Law, an Accredited Mediator with the Kenyan Judiciary and is currently pursuing a Masters of Arts degree in Human Rights at the University of Nairobi. Based on her experience, she was selected to participate on behalf of FIDA-Kenya in the Strategic Litigation Committee to formulate the strategy, research, data collection and drafting of the pleadings in the landmark case of the “160 Girls” Meru Petition No. 8 of 2012 which set precedence on how Gender Based violence cases are handle from the point of reporting at the Police Station to prosecution in a Court of Law.

In 2017 she was appointed by the Mediation Accreditation Committee of the Kenyan Judiciary to train and equip the Senior Judiciary Staff on the process of Mediation with the introduction of the Court Annexed Mediation Pilot Program as a form of dispute resolution as encompassed in Article 159 of the Kenyan Constitution 2010.

Based on her strong work ethics and a clear dedication to the rule of law she successively filed Petition No. 347 of 2015 “Y” versus The AG and two others to challenge the excessive acts of the Police in the manner in which they conducted the search on a high school student and posting her nude photographs on social media which went viral thus violating her fundamental rights that are guaranteed under the Kenyan Constitution 2010. Judgment was entered for the Petitioner in the sum of Kenya Shillings Four Million (Kshs. 4 million).

Her opinions are well thought out and clearly articulated as she sits as a Representative of the Law Society of Kenya at the Disciplinary Committee since February 2012 to 2015 and February 2018 to date where she has serves diligently. She’s persistent and as a leader and a member of the LSK Disciplinary Tribunal initiated collaboration between the Advocates Complaints Commission, the LSK Disciplinary Committee and the Kenya School of Law geared to enhance the ethical standards of the Legal profession by giving lectures on the practical approach to Professional Ethics and the Disciplinary System to the students.

Gladys Wamaitha is dependable and pays careful attention to detail as a result of which in 2012 she was appointed a Private Prosecutor and handled the “Justice for Liz” Busia Criminal Case No. 1924 of 2013 Republic versus Dismas Otieno and 2 others wherein the accused were convicted for gang rape.

Calvin Nyachoti, C. Arb. LLB, LLM; MBA; CPS(K)

Immediate Past Chairman, Chartered Institute of Arbitrators (Kenya Branch)

Calvin Nyachoti is the immediate past Chairman of the Chartered Institute of Arbitrators (Kenya Branch).

Mr. Nyachoti is by primary profession, an Advocate of the High Court of Kenya and Certified Corporate Secretary (CPS(K)) with broad experience as a dispute resolver, corporate secretary and legal services management.

As a Chartered Arbitrator, Mr. Nyachoti has handled and successfully resolved several disputes in dispute adjudication boards, arbitration and mediation references. Mr. Nyachoti also consults as well as trains on: alternative dispute resolution (ADR), the management and regulation of retirement benefits, corporate governance and institutional development.

Mr. Nyachoti holds a Masters Degree in Law (LLM); an MBA in Strategic Management; a Postgraduate Diploma in Law (KSL); a Bachelor of Laws Degree (LLB); Studies in Public International Law and Leadership and Team Skills among other qualifications.

He brings great zeal and experience from training and working in various sectors and facilitating the resolution of disputes.

Retired Judge Mary Ang’awa

Lawyer, Arbitrator, Mediator

A career Judicial Officer for 35 years(13 years as a Magistrate and 22 years as a Judge of the High Court of Kenya) Judge Ang'awa holds a Master of Laws, degree (2005) and a Bachelor of Laws degree (1979) from the University of Nairobi. She is an Advocate of the High Court of Kenya(1980), was Secretary to the Commission of Inquiry into the Insurance Industry(1986-1988), Chairperson of the Rent Restriction Tribunal(1989-1991) and a Commissioner with the Advocates Complaints Commission(1991-1993).

Judge Ang’awa is now retired from the bench.

Judge Angáwa is a Fellow of the Chartered Institute of Arbitrators (2000), the Eisenhower Fellowship (1998),and a visiting Fellow of the Federal Judicial Centre, Washington DC (1998). She is an Accredited Mediator of the Chartered Institute of Arbitrators(2016). She has been Chairperson of both the Kenya Women Judges Association (2005-2010) and the Jurisprudence of Equality Program (2001-2005), a human rights program on gender laws. She is a Trustee of the President's Award Kenya (A Duke of Edinburgh International Award). A Trustee of the Junior Golf Foundation.

She is also an active tutor with the Chartered Institute of Arbitrators, Kenya Chapter in their Introductory Courses held for Arbitration and Mediation

Marube Charles Getanda

Career advocate

Mr. Marube Charles Getanda is a career advocate with an experience of over twenty years in legal practice. He is also lecturer at the department of commercial law, Faculty of Law, Egerton University. He holds a Bachelors degree in Law (LLB) from Nairobi University (1994); a Postgraduate Diploma from Kenya School of Law (1995) and a Masters degree (LLM) in Corporate Law and Finance from Widener University School, USA (2004). He has a certificate in mediation; certificate in family mediation; certificate in mentorship of mediators; certified trainer of mediators and advanced certificate in mediation from Mediation Training East Africa (MTI). He also has a certificate in International Arbitration from CIArb. He has written and published in mediation. He has wide experience in mediating disputes as well as a training of mediators. He has interest in commercial, family and workplace mediation. He is a member of a number of professional associations.

Jemimah Keli

Advocate, High Court of Kenya

Ms. Keli is an Advocate of the High Court of Kenya of over 18 years post-admission experience, an Arbitrator (MCIArb), Mediator, and a part-time lecturer at the Kenya School of Law (KSL). She is also gazetted as a conciliator of labour disputes with the Ministry of Labour and Social Protection of the Government of Kenya, and a Mediator with the Federation of Women Lawyers (FIDA- Kenya).

Prior to embarking on teaching at the School of Law and private legal practice at Keli & Associates Advocates, she served as an Assisting Counsel at the Judges and Magistrates Vetting Board, a Program Officer (Ethics and Compliance) at the Law Society of Kenya (LSK), and a Senior State Counsel at Civil Litigation at the State Law Office. She is also an active trainer with the LSK on trial advocacy skills in their Continuous Professional Development Programme (CPD).

She is widely published on the Chartered Institute of Arbitrators (CIArb) Journal on Alternative Dispute Resolution and the LSK CPD Digest. In practice, she has sat in ten arbitral tribunals, and in three of those, as the Chairperson. She has also mediated over thirty commercial disputes under the Court Annexed Mediation programme at the Judiciary in Kenya.

Ms. Keli holds a Master of Laws (LL.M.) and a Bachelor of Laws (LL.B.) degree from the University of Nairobi, a Postgraduate Diploma in Law from KSL and an Advanced Certificate in Domestic Arbitration from CIArb.

Jacqueline Lule

Barrister

Jacqueline is a Barrister, (Middle Temple), a Fellow of the Chartered Institute of Arbitrators, (FCIArb) and a C.E.D.R Accredited Mediator.

She practiced at the independent Bar in the UK for 17 years, whilst teaching at BPP Law School for over 10 years. In 2015, she took up partnership at the Kampala office of Bowmans, a pan-African commercial law firm, where she advised large corporates, foreign governments, Aid Agencies, and INGO’s, on their legal and regulatory responsibilities in Uganda.

Jacqueline has arbitrated and mediated numerous commercial disputes. She has also provided training, and spoken at a number of arbitration events held by the IBA, LCIA, NCIA, KIAC, EALS, ULS, ICAMEK, Young ICCA, ICC YAF, and the ILI-ACLE. She also serves on arbitration committees at MIAC, LCA, LCIAC, and LACIAC.

Jacqueline holds LL.M’s in Human Rights Law, and Commercial and Corporate Law, from S.O.A.S, and QMUL, University of London respectively.

Dr. Francis Kariuki

Lecturer, Strathmore University Law School.

Dr. Francis Kariuki holds a Bachelor of Laws (LL. B) and a Master of Laws degree (LL.M) from the University of Nairobi, and a Doctor of Philosophy (PhD) degree from the University of the Witwatersrand in South Africa. He is a lecturer at Strathmore University Law School.

Francis is an Advocate of the High Court of Kenya, and a Fellow of the Chartered Institute of Arbitrators (CIArb) London and Kenya. He is also a listed arbitrator and mediator with the Nairobi Centre for International Arbitration (NCIA) in Kenya, and a member of the Strathmore Dispute Resolution Centre (SDRC). He is also accredited as a mediator by the Mediation Accreditation Committee (MAC) under the Kenyan Judiciary.

He research interests are in traditional justice systems, natural resources law and alternative dispute resolution (ADR).

Eunice Lumallas

Dispute Resolution Practitioner

Dispute Resolution Practitioner and passionate trial Lawyer, acts both as third party neutral and Party Representative in domestic and International Disputes, keen interest in Gender & Diversity and Governance. Fellow of the Chartered Institute of Arbitrators (London) and is an accredited tutor in Arbitration and mediation. Listed in the panels of the Kigali International Arbitration Centre (KIAC), Nairobi Centre for International arbitration (NCIA), the Lagos Court of Arbitration (Abuja) the Mauritius Arbitration and mediation Centre (MARC), London Court of International Arbitration (LCIA) and the Lagos Chamber of Commerce International Arbitration Centre. Holds a Masters degree in Public International Law and is Managing Partner in the Firm of Lumallas, Achieng & Kavere (LAK) Advocates operating in East Africa with Headquarters in Nairobi. Serve in the Boards of Skipper Seil Limited, the Public Private Partnerships Petitions Committee (PPPPC), Chartered institute of Arbitrators and is Member of Federation of Women Lawyers (Kenya), Association of Professional Societies in East Africa (APSEA), Women in ADR and the Women on Boards Networks.

Florence Oduk

Arbitrator/Mediator

Florence Oduk specializes in policy and regulatory arrangements relating to infrastructure, environment and natural resource law. She is a lawyer and ADR Practitioner, with a bias for commercial and natural resource disputes.

Florence is accredited by the Judiciary of Kenya and panel-listed by the Nairobi Centre for International Arbitration as well as the Chartered Institute of Arbitrators as an Arbitrator and Mediator.

She is an engaging and knowledgeable Technical Trainer with over 10 years experience and a proven track record of preparing her trainees to become dispute resolvers who can produce quality outcomes, in a timely and cost effective manner.

She is a dynamic communicator with excellent presentation skills and is able to translate complex concepts into understandable terms using creative teaching methods.

Florence is also extremely versed in undertaking public participation and stakeholder dialogue and possesses strong facilitation skills enabling her to assist multi-party groups to pool their diverse views into consensus.

David Njuguna Njoroge, FCIArb

Advocate, High Court of Kenya

David Njuguna Njoroge, FCIArb is a holder of a Bachelors of Law LL.B from Makerere University and a Post Graduate Diploma in Law from the Kenya School of Law. He is an Advocate of the High Court of Kenya of Ten Years Standing. He is an ADR practitioner, MAC Accredited Mediator and an Arbitrator of Fellow status (FCIArb) of the Chartered Institute of Arbitrators.

David is a Member of the State Corporations Appeals Tribunal. He is also a Member of the National Steering Committee for the Formulation of the Alternative Dispute Resolution Policy appointed by the AG.

David is the Senior Partner at Njuguna & Njuguna Co. Advocates where he heads the Dispute Resolution Department. He is an Approved Tutor of the Chartered Institute of Arbitrators and a prequalified ADR Tutor at NCIA.

David is a former Council Member of the Law Society of Kenya 2018-2020 and 2016-2018; In November 2016, he was elected as one of the three Kenyan Council Members of the East Africa Law Society 2016-2018.

Mercy Akeyo Okiro, MCIArb

Advocate, High Court of Kenya

Mercy Okiro is an Advocate of the High Court of Kenya, trained Arbitrator, Accredited Mediator and Construction Adjudicator. She is an Accredited Tutor and Assessor of the Chartered Institute of Arbitrators (London) and the Nairobi Centre for International Arbitration (NCIA) As well as an Adjunct Faculty Member at the Mount Kenya University School of Law. Mercy holds a Master of Arts degree in International Studies from the University of Nairobi and is currently writing her dissertation for the award of a Master of Laws degree with Queen Mary University of London.

Mercy is on the panel of Arbitrators for the Kigali International Arbitration Centre, the Chartered Institute of Arbitrators, Kenya, the Just and Fair Mediation Centre (Turkey) and the COVID-19 ADR Initiative (CADRI) Panel of Neutrals. She is also listed on the panel of pro bon lawyers of the Sports Disputes Tribunal in Kenya and the Court of Arbitration for Sports in Lausanne, Switzerland.

She sits on the Council of the Association of Young Arbitrators and is an ICC Young Arbitrators Forum Representative for Africa, Middle East and Turkey. She also serves as an Ambassador for the Alliance for Equality in Dispute Resolution, Arbitrator Intelligence and Racial Equality for Arbitration Lawyers(REAL). She is part of the Steering Committee of the Equality for Representation in Arbitration, Africa. Mercy is also the Joint Secretary of the Executive Committee of the Africa Asia Mediation Association and a Fellow of the World Mediation Organization. She sits on two Kenya Private Sector Alliance Sector Boards, the National Technical Committees of the Kenya Bureau of Standards and Ministry of Sports, Arts and Culture Working Groups amongst other local and international boards.

She was feted in 2019 as the “The Young African Arbitration Practitioner of the year 2019” and was listed as one of Africa’s Most Promising Young Arbitrators 2020 by the Association of Young Arbitrators. She publishes articles on sports law, procurement law, legal audits and compliance, gender and youth empowerment, mediation and arbitration regularly and has spoken in numerous conferences regionally and internationally on these areas.
